Abstract

The purpose of the article is to consider the key problems of institutionalization of the State Council in Russia. As a result of the 2020 constitutional reform, the State Council received constitutional confirmation and a new status. The authors present the analysis of the role, functions, composition of this body during the period of the Russian Empire. The issues of functioning of the Council in the modern (post-Soviet) history of Russia as an advisory and council body are revealed. A significant difference in the functionality of the State Council during the period of the Russian Empire was a close analysis of all the most important drafts of regulatory documents (laws) that were subject to approval by the sovereign. Since 1993, the Council has existed exclusively in the status of an advisory and council body under the President. Since 2000, the State Council has become the platform for analyzing and developing formats for the strategic development of entire sectors of the national economy. As a result of the analysis, the authors come to the conclusion that taking into account the new constitutional status the problem of duplication of powers with the existing bodies of state power arises; therefore, the most important question remains about specifying its place in the existing system of separation of powers, the order and principles of its formation.
