INNOVATIONS IN LAW ENFORCEMENT PRACTICE AND RUSSIAN CIVIL LEGISLATION UNDER THE CONDITIONS OF IMPORT SUBSTITUTION

Abstract

The article describes the present stage of implementation of the concept of «geographical indication" in the Russian civil legislation and relevant regulation of appellations of origin and geographical indications of goods in the EAEU. The relevance of this article is determined by the successful policy of import substitution within the national economy, which set the impetus for development in the agricultural sectors, on the basis of which a model development of the legal regulation of the appellation of origin (first of all, winemaking) is possible. The questions of influence of the current law-enforcement practice on the formation of means of individualization are examined. The authors come to the conclusion that there is a feedback mechanism aimed at modernizing the legislation. Such a move follows the international process of harmonization of the right regulation of the appellation of origin. The legal status of the terms "geographical indication" and "name of place of origin" in the Eurasian Economic Community is of particular interest for analysis. The authors note that the disparity in the legal regulation of these means of individualization, existing among the member states of the community, remains at the supranational level, in the absence of the necessary legal instruments.
